Terms of Service

Welcome to Native Gardens LLC (“Native Gardens,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website at nativegardens.co and the landscaping, holiday decorating, and related services we provide.

1. Services

Native Gardens provides native plant landscaping design, installation, and maintenance services, as well as holiday botanical decorating services in the Fort Collins, Colorado area. All services are subject to availability and scheduling.

2. Estimates and Proposals

We provide free initial consultations and written proposals for all projects. Proposals are valid for thirty (30) days from the date of issue unless otherwise noted. Prices in proposals may be adjusted if the scope of work changes or if material costs change significantly before acceptance.

3. Payment Terms

• A deposit of 50% of the total project cost is required before work begins, unless otherwise agreed in writing.
• The remaining balance is due upon completion of the project.
• For maintenance services, payment is due at the time of service or per the terms of your maintenance agreement.
• Payments may be made by credit card, check, or bank transfer.
• Late payments are subject to a 1.5% monthly finance charge after 30 days past due.

4. Scheduling and Access

You agree to provide reasonable access to your property for the performance of services. If access is not available at the scheduled time without prior notice, a rescheduling fee may apply. Weather delays, supply chain disruptions, and other factors beyond our control may affect project timelines. We will communicate any significant delays promptly.

5. Plant Warranty

We offer a one-year warranty on plants installed as part of a full-service landscaping project, subject to the following conditions:

• You must follow the watering and care instructions provided at the time of installation.
• The warranty does not cover damage caused by animals, extreme weather events, chemical applications, or neglect.
• Replacement plants will be of the same species and comparable size. Labor for replacement planting is included.

6. Cancellation Policy

You may cancel a project before work begins. Deposits are refundable minus any costs already incurred for materials, design work, or permits. Once installation has begun, cancellation refunds will be prorated based on work completed. Holiday decorating cancellations within 14 days of the scheduled installation date may forfeit the deposit.

7. Liability Limitations

Native Gardens carries general liability insurance and workers' compensation coverage. Our liability for any claim arising out of our services is limited to the total amount paid for the specific service giving rise to the claim. We are not liable for pre-existing property conditions, underground utility damage not identified through standard locating procedures, or any consequential or incidental damages.

8. Website Use

You may use our website for personal, non-commercial purposes. All content on the website, including text, images, designs, and logos, is the property of Native Gardens LLC and is protected by copyright law. You may not reproduce, distribute, or use our content without written permission.

9. Governing Law

These Terms are governed by the laws of the State of Colorado. Any disputes arising from these Terms or our services shall be resolved in the courts of Larimer County, Colorado.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
